Lady Nina Clothings & Fabrics does not operate a physical shop at this location. Visits are only possible by prior appointment.

SECTION 2 – APPLICABILITY

These Terms and Conditions apply to all offers, orders, purchases and agreements made through LadyNina.nl.

Before completing an order, customers will be given the opportunity to review these Terms and Conditions. By placing an order, the customer confirms that they have read and accepted them.

Any deviation from these terms is only valid if agreed to in writing by Lady Nina Clothings & Fabrics.

Mandatory consumer rights under applicable law always remain in effect and cannot be excluded by these Terms and Conditions.

SECTION 3 – ONLINE STORE USE

You may only use this website and our products for lawful purposes.

However, colours may appear slightly different depending on the screen, device or display settings used. Handmade or natural products may also have minor variations in colour, shape, texture or finish. Such natural variations are not automatically considered defects.

All products are subject to availability. We reserve the right to change or discontinue products, provided that this does not affect orders that have already been accepted.

SECTION 5 – PRICES AND PAYMENT

All prices displayed on LadyNina.nl are stated in euros and include VAT unless clearly stated otherwise.

Shipping costs and any other applicable charges will be shown before the customer completes the order.

We may change our prices at any time. Price changes do not affect orders that have already been accepted.

Payment can be made using the payment methods available during checkout. Customers are responsible for providing complete and accurate payment and billing information.

If an obvious pricing or technical error occurs, we may contact the customer to correct or cancel the order where legally permitted. If a paid order is cancelled, the customer will receive a full refund.

SECTION 6 – ORDERS AND AGREEMENTS

After placing an order, the customer will receive an order confirmation by email. This confirms that we have received the order.

We reserve the right to reject or cancel an order for legitimate reasons, including:

  • A product is unavailable;
  • Payment cannot be authorised;
  • The supplied information is incorrect or incomplete;
  • There is an obvious pricing or product-information error;
  • We reasonably suspect fraud, misuse or unauthorised resale;
  • Delivery to the supplied address is not possible.

If we cancel a paid order, the amount paid will be refunded using the original payment method.

Customers must provide complete and accurate contact, billing and delivery information. Lady Nina Clothings & Fabrics is not responsible for delays caused by incorrect or incomplete information supplied by the customer.

SECTION 7 – SHIPPING AND DELIVERY

Orders will be delivered according to the delivery information shown during checkout and described in our Shipping Policy.

Delivery dates and times are estimates unless expressly agreed otherwise. Delays caused by carriers, customs, severe weather, public holidays or other circumstances beyond our reasonable control may occur.

If no delivery period has been agreed, we will deliver the order within the period required by applicable consumer law.

The risk of loss or damage passes to the consumer when the consumer, or a person designated by the consumer, physically receives the order.

SECTION 8 – RIGHT OF WITHDRAWAL

Consumers generally have the right to withdraw from an online purchase within 14 days after the day on which the product is received, without providing a reason.

To exercise this right, the customer must clearly notify us within the withdrawal period. This can be done by emailing info@LadyNina.nl or by using the online withdrawal function available on our website.

After notifying us, the customer has an additional 14 days to return the product.

The customer may inspect the product as they would in a physical store. The customer may be responsible for any reduction in value caused by handling the product beyond what is necessary to establish its nature, characteristics and functioning.

Unless otherwise stated, the direct costs of returning a product are the customer’s responsibility.

Some products may be excluded from the right of withdrawal, including:

  • Products made according to the customer’s specifications;
  • Clearly personalised products;
  • Products that deteriorate or expire quickly;
  • Sealed products that cannot be returned for health or hygiene reasons once the seal has been broken;
  • Other products excluded under applicable consumer law.

SECTION 9 – RETURNS AND REFUNDS

Returned products must be sent to the return address provided by Lady Nina Clothings & Fabrics. Customers must contact us before returning an order and should not automatically use the address printed on the original shipping label.

When a consumer validly withdraws from the full purchase, we will refund all eligible payments, including the standard delivery costs. Additional costs resulting from a more expensive delivery method are not refundable.

If only part of an order is returned, the original delivery costs will not be refunded.

Refunds will be issued within 14 days after we are informed of the withdrawal. We may withhold the refund until we have received the product or until the customer provides proof that it has been returned, whichever occurs first.

Refunds will be made using the original payment method unless another method is expressly agreed.

SECTION 10 – DAMAGED, DEFECTIVE OR INCORRECT PRODUCTS

Customers should inspect their order after delivery.

If a product is damaged, defective, incomplete or incorrect, please contact us as soon as possible at info@LadyNina.nl. Include the order number, a description of the issue and clear photographs where possible.

We will assess the situation and provide an appropriate solution, such as repair, replacement or a refund, depending on the circumstances and applicable law.

SECTION 11 – LEGAL WARRANTY

Customers are entitled to the statutory warranty provided by applicable consumer law. This means that a product must have the qualities and functionality that the customer may reasonably expect.

Nothing in these Terms and Conditions limits or excludes the customer’s statutory warranty rights.

Damage resulting from misuse, improper care, normal wear and tear or use contrary to the supplied instructions may not be covered by the legal warranty.

If customers create an account, they are responsible for keeping their login details confidential and for activities performed through their account.

These Terms and Conditions and all agreements with Lady Nina Clothings & Fabrics are governed by Dutch law.

If the customer lives in another country, this choice of law does not remove any mandatory consumer protection provided by the laws of that country.

The parties should first attempt to resolve disputes through direct communication. If no solution can be reached, the dispute may be submitted to the competent court. Consumers retain all mandatory rights concerning the court or dispute-resolution body they may use.
